A former sales manager of a moulding machine manufacturer, charged by Hong Kong's ICAC, was today (Friday) sentenced to eight months' imprisonment at the District Court for accepting advantages totalling over HKD246,000 from a distributing agent in relation to the sale of plastic injection moulding machines.
Chan Kam-ting, 44, a former sales manager of Foshan Shunde Chen De Plastics Machinery Co., Ltd. (Chen De), was also ordered to pay a restitution of HKD100,000 to Chen De.
The defendant was earlier found guilty of three counts of agent accepting an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance.
In sentencing, Judge Mary Yuen Lai-wah said the bribery offences committed by the defendant were detrimental to the clean business environment in Hong Kong.
The court heard that Chen De, a subsidiary of publicly listed Chen Hsong Holdings Limited, appointed Createx Engineering Company Limited (Createx) as a distributing agent for plastic injection moulding machines.
Between July 2004 and December 2006, Chen De and Createx entered into 132 sales contracts.
A marketing manager of Createx instructed his staff to issue three cheques for a total amount of over HKD246,000 payable to the defendant.
The advantages were calculated at 0.5% of the total value of the above sales contracts, the court heard.
